Terms of Service

By accessing or using the Business Vitality Tracker (BVT) platform operated by Vital Global Communities Pty Ltd, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Business Vitality Tracker is an independent business verification and certification platform. We assess and certify the vitality of Australian businesses across financial, operational, and governance dimensions. Our certification provides independent verification for funders, partners, and stakeholders.

By registering on the BVT platform, you agree to:

• Provide accurate and truthful information, including your Australian Business Number (ABN), legal business name, and contact details
• Not misrepresent your business information or fabricate assessment responses
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorised access to your account
• Comply with all applicable Australian laws and regulations

Verification fees are charged on a per-application basis according to your business tier:

• SME tier: $199 AUD per verification application
• Enterprise tier: $299 AUD per verification application

All verification fees are non-refundable once payment has been processed, regardless of the outcome of the verification review. By submitting payment, you acknowledge that the fee covers the administrative and review costs incurred by BVT.

Payments are processed securely through Stripe. BVT does not store your payment card details.

BVT retains the sole right to grant, withhold, suspend, or revoke certification at its discretion. Certification is subject to:

• Satisfactory completion of required assessments
• Submission and review of supporting documentation
• Ongoing compliance with BVT standards

Certificates are valid for a period of 12 months from the date of issue, after which renewal is required. BVT may revoke certification at any time if it becomes aware of misrepresentation, material changes to business circumstances, or other grounds for disqualification.

The BVT platform, including its software, content, trademarks, logos, and certification marks, is the intellectual property of Vital Global Communities Pty Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the platform for the purpose of obtaining and displaying your BVT certification.

You may not reproduce, distribute, or create derivative works from our intellectual property without prior written consent.

To the maximum extent permitted by law, Vital Global Communities Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the BVT platform or services. Our total liability to you shall not exceed the fees paid by you in the 12 months preceding the claim.

Nothing in these terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under Australian Consumer Law.

These Terms of Service are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from these terms or your use of our services.

We may update these Terms of Service from time to time. Material changes will be notified via email to registered users. Continued use of the platform following notification constitutes acceptance of the revised terms.
